Amendments to the Competition Act bring significant changes to environmental claims, pricing transparency and consumer rights. Here is an overview of what marketers need to know: - Environmental Claims: New standards explicitly outline requirements for communicating environmental benefits or impact. - Environmental Protection Collaborations: New voluntary certification program for environmental friendly and sustainability initiatives. - Private Rights of Action: Starting June 20, 2025, individuals can sue organizations for deceptive marketing. - Drip Pricing: Advertised prices must include all mandatory charges, except government fees like sales tax. CMA’s Director, Public Affairs and Regulatory Standards, Florentina Stancu-Soare, recommends three steps to take to stay ahead and meet the requirements of the law: 1. Stay informed. 2. Strengthen your approach to compliance. 3. Audit campaigns, ESG claims, and review internal compliance practices. The Canadian Marketing Association recently shared insights with the Competition Bureau Canada on how AI might affect competition in the marketplace. Here are some key takeaways: ➡️ AI can foster competition and offer significant benefits by democratizing innovation and allowing businesses of all sizes to enhance decision-making and operational efficiency. ➡️ By leveraging AI, organizations can optimize supply chains, personalize consumer experiences, and create innovative products and services. ➡️ AI can drive market intelligence, helping businesses remain agile in rapidly changing market dynamics. ➡️ Three key principles at the core of a meaningful AI framework would be transparency, consent where a reasonable person would not expect AI to be used and where there is a significant risk of harm, and fairness and non-discrimination. ➡️ Avoiding unnecessary regulation is critical to fostering healthy competition domestically and globally. The CMA supports the Bureau’s commitment to a pro-competitive marketplace that encourages innovation and relies on market forces to achieve the benefits of competition. This is best achieved through a combination of regulation, self-regulation and guidance.
